Terms & Conditions
Please read the following Terms and Conditions carefully before proceeding with your booking. These Terms and Conditions are subject to change without notice, from time to time in our sole discretion. Biking BA will endeavor to communicate the most updated Terms and Conditions to our clients when changes occur.
1. Definitions
'Biking BA' shall mean Biking Buenos Aires. 'You’ or ‘passenger’ shall mean the person in whose name the booking is made and shall include the person or persons on whose behalf the same is made. 'Force Majeure' shall mean any event outside Biking BA's control, including but not limited to war and civil strife etc., which prevents the prompt performance of its obligations.
2. General Information
General information included in the website (www.bikingbuenosaires.com) is for help and guidance. The contract incorporating these conditions shall be governed by Argentine law and any matters arising out of it shall be subject to the jurisdiction of the Courts of Argentina, Ciudad Autonoma de Buenos Aires.
3. Tours
3.1 A regular group tour lasts between 3 - 7 hours. On the occasion that an attraction is closed or the group experiences an unforseen event (flat tire, protest, etc.) the tour may last more or less than the originally stated time. The routes are fixed; however, due to unexpected road closures, protests, traffic, etc., we sometimes have to find the next best alternate route. Only private tours are allowed to customize tours to their specifications so long as the tour doesn't exceed the indicated maximum time.
3.2 The minimum number of passengers to start any group tour is one. In the rare event that the passenger wants to join a different group tour than the one reserved, Biking BA will work with the passenger to make an alternative arrangement that best suits the situation.
3.3 There is no rescheduling for prepaid tours in the 24 hours before the tour starts. Also see point 11.1 & 11.2
3.4 If a passenger is absent or late, there is no refund or rescheduling of his/her tour without prior notice.
3.5 Private tours require at least 24 business hours to schedule or reschedule.
3.6 During high season, Biking BA reserves the right to introduce morning tours. Biking BA will notify passengers when such option is available but the schedule will be ultimately determined by Biking BA.
4. No Show and Late Arrival Policy
4.1 In any situation where the passenger(s) do not show up for their scheduled tour and they are the only passenger(s) in the tour, Biking BA reserves the right to cancel the tour after 20 minutes of waiting unless notification of late arrival has been made in advance. Once the tour has been cancelled, rescheduling of the next available tour will be made accordingly.
4.2 Tours start and end as scheduled by Biking BA. If a passenger arrives late, the tour time missed is not refundable nor can it be rescheduled.
5. Travel Documents and Insurance
Passenger is fully responsible for having all necessary valid travel documents, travel insurance and medical insurance. Any non-compliance and any resulting damages are the sole responsibility of the passenger. Biking BA reserves the right to refuse a passenger to join any of its activities or excursions if such passenger fails to prove that he/she has the required travel documents and/or insurance to participate safely.
6. Prices
The prices stated on the website are the official charges; prices in any printed flyers, brochures, advertisements or other materials are for indication only. Prices are subject to change at any time. In the case that only partial payment was made by a passenger and the prices changed, it is at the discretion of Biking BA to decide whether or not to honor the price from the time of booking to the passenger upon completion of the full payment.
7. Discounts
7.1 Discounts for private group tours are solely up to the discretion of Biking BA and are subject to change if the original agreement is modified.
7.2 Discounts that are offered directly by BikingBA cannot be combined with any other discounts offered by third parties, unless stated otherwise.
8. Booking and Payment
8.1 Due to the limited capacity of each tour, spots are available according to reservations and then on a first come first serve basis. Therefore, spot is not guaranteed and booking is not finalized until full payment has been processed and a confirmation receipt has been issued. Full payment must be paid before the tour. Biking BA reserves the right to refuse a passenger from joining tours until full payment has been paid.
9. Special Requirements
Any special requests must be advised to Biking BA at the time of reserving the tour in writing.
10. Changes by the passenger
10.1 If a passenger wants to make changes to a booked and paid tour (include privatizing tour, alternative tours, etc.) before his / her tour has started, the request must be made to Biking BA in writing, and Biking BA reserves the right to charge an administration fee of up to US$25 per person per change to cover the additional administration involved.
10.3 If a passenger wants to reschedule his/her private tour, the request must be made at least 24 hours before tour starts. If the required time is not met, the tour will not be rescheduled and no refund will be given. The reschedule time will depend on the tour schedule availability.
11. Cancellation and Refund Policy
11.1 If a passenger wants to cancel a booking, the request must be made to Biking BA in writing. The date of cancellation will be the date that Biking BA receives the letter or email.
11.2 Biking BA offers 100% refunds if the reservation is cancelled more than 24 hours (1 day) prior to the scheduled tour. Biking BA does not offer refunds for any reason once within 24 hours of the scheduled tour.
12. Changes by Biking BA
Biking BA reserves the right to modify or cancel its services arrangements if unforeseen circumstances arise. If Biking BA cancels or significantly changes the elements of a booked program due to force majeure, on or before the start date of such program, Biking BA will inform the passenger as soon as possible and will put its utmost effort to arrange alternatives that are of equal value. If force majeure occurs while the program is in progress, Biking BA will try to make reasonable alternative arrangements as well.
13. Liability of Biking BA
Biking BA is responsible for making sure that all services are supplied as described and that they all reach reasonable standard. However, Biking BA will not be liable for the failure or improper performance of these products and services where such failure or improper performance is attributable to a) the fault of the passenger, b) the unforeseeable or unavoidable actions of an unconnected third party, c) unusual and unforeseeable circumstances beyond Biking BA's control, including force majeure.
14. Codes of Conduct
Passengers are expected to behave respectfully to others, including but not limited to fellow passengers, guides, staff and/or activity personnel, and to the property of others, including but not limited to shared facilities and public environment. Also, passengers are expected to obey the laws and adapt to the customs of the country they travel in. The Codes of Conduct is outlined as such and serves as a guideline for all Biking BA passengers to follow.
Biking BA reserves the right to remove a passenger from his/her tour if such passenger violates the Codes of Conduct. No refund will be given, and the passenger must pay the full compensation for any damages that might have been caused.
15. Privacy Policy
All the personal information that is collected during the Biking BA registration process will be used for Biking BA administration and booking purposes only. Biking BA does not rent, sell, or share personal information about you with other people or non-affiliated companies except to provide products or services you've requested. Biking BA may occasionally send news, such as information on our current events, special events happening in Buenos Aires during your stay, special promotions etc. to your provided email address. You can always reply to unsubscribe at anytime.
